Southern African-German Chamber of Commerce and Industry NPC

Dear Reader,

A fresh wind is blowing in South Africa, since the resignation of former President Jacob Zuma and the appointment of Cyril Ramaphosa (CR 17) as the new State President. This atmospheric change is being referred to as “Ramaphoria”.

On Monday, 26 February, President Ramaphosa, announced his first cabinet shuffle. Among the newly appointed and re-appointed ministers were many familiar names. Positive and negative sentiments balanced out.

The morning after showed a certain disenchantment. In the media, the keyword was “compromise”. While the sentiments around Ministers Nene in the Department of Finance and Gordhan in the Department of Public Works were overwhelmingly positive, the appointment of other ministers raised doubts about a new beginning and the overhaul of the SA economy.

We will see what the future holds. The Chamber and its members wish the new cabinet under the leadership of President Ramaphosa wisdom and the ability to move South Africa forward on a path towards economic prosperity and social peace.

The Chamber and its members will continue to engage with the leadership of the country in constructive discussions on how to retain existing foreign investment in the country, and attract new investment, while creating an economic environment that promotes “a better life for all”.

In the past weeks, the Chamber showed its commitment to the positive development of the country and the southern African region.

During the Mining Indaba in Cape Town, the Chamber organised a “German Day” on 6 February, where the German Mining Network displayed the interest of German companies to partner with companies from Southern Africa.

On 13 February, the Chamber organised a seminar on recent developments in Zimbabwe. More than 60 members and friends participated in the event and discussed opportunities for partnerships in the country. The German Ambassador to Zimbabwe, Dr. Thorsten Hutter, representatives from the Zimbabwean Consulate General, and Zimbabwean businesses informed our members about the economic environment in the country.

Seminars on the “Senior Expert Service (SES)” took place in Johannesburg and Durban. The short-term experts offer great advice on the improvement of small and medium sized enterprises with a hands on approach. (Please click here for more information on SES).

The coming weeks and months will see the arrival of a number of high-ranking delegations from Germany to SA.

From 6 – 13 May, a delegation from Lower Saxony, headed by Minister President St. Weil, will visit SA, in particular Gauteng, the partner province Eastern Cape and the Western Cape.

From 1 – 10 June, a delegation of 65 from the Federal State of Bremen and Bremerhaven, headed by the President of the Senate, Carsten Sieling, will visit South Africa and Namibia.

We are looking forward to fruitful and successful discussions over the course of these visits.

Best regards

Matthias Boddenberg

Multi-nationals with a global policy prohibiting the parting of ownership (eg BEE) in foreign jurisdictions?

Broad Based, Black Economic Empowerment (hereinafter “BEE”), whilst not compulsory, has become a business imperative for most organisations, but is also one of the biggest threats if not understood and implemented properly. The reality of BEE in context of the broader economy is that though the Broad-Based Black Economic Empowerment Act 2003 as amended by Act 46 of 2013, is not compulsory, the inclusion or exclusion of your business in trade could be determined by your strategic action towards BEE. BEE could be the single game changer in the future as new legislation increases the impact of non-compliance.
