Dear Members and Friends,

On behalf of the Directorate, Senior Council and staff of the Chamber, I would like to wish all our members and friends a happy, healthy and successful year in 2017!

Once again, the year will most certainly hold a number of challenges for local and foreign companies in South Africa.

In December 2016, Dr Rob Davies, Minister of Trade and Industry in South Africa, gazetted the draft regulations on mediation with regards to the Investment Promotion and Protection Act. Most South Africans and their foreign counterparts had already gone into “Holiday Mode”, so the publication basically went unnoticed by many.

In essence, the regulations are very far from the mediation rules as promoted by the International Bar Association (IBA).

Only to mention 2 points of concern:

  1. The regulations of the Department of Trade and Industry stipulate that mediation will only be available if and when government and the investor have agreed to go for mediation. However, the Act defines the mediation as a legal right of the investor. In so doing, the regulations limit the right of the investor in spite of what is stipulated in the Act. 
  2.  It is a rule, according to the mediation rules set by the IBA, that the outcome of the mediation process is a written and signed binding settlement. This is not contained in the mediation regulations of the Department of Trade and Industry. 

All in all, the regulations as gazetted by the Department fall short of expectations of foreign investors and do not entice foreign investment in the way that is urgently needed to deal with the economic challenges in SA.

On a more positive note: The German African Business Summit is going to take place in Nairobi from 8 – 10 February. It will be a meeting of German and African Business representatives a number of important topics.

We have to bid farewell to Ambassador Walter Lindner. 

Walter Lindner, the German Ambassador in South Africa arrived in the country on July 17, 2015. Ambassador Lindner previously served as the spokesperson of the German Foreign Minister, Germany’s Ambassador to Kenya, Director for Sub-Saharan Africa in the German Foreign Office and as the Special Representative of Chancellor Merkel for the Ebola Crisis.
Ambassador Lindner received a call from the newly appointed Minister of Foreign Affairs, Sigmar Gabriel, to return to Berlin and to serve there as State Secretary.

We wish Ambassador Lindner all the best, and plenty of success in these (globally) difficult and challenging times.

The first international Online Degree Programme in maritime logistics

Porsche launches educational training project

Porsche is rolling up its sleeves to help socially disadvantaged young adults in South Africa by opening the new Porsche Training and Recruitment Center in Cape Town.

From mid-2017, a total of 75 young men and women will be given the opportunity to train as service mechatronics at the new Porsche Training and Recruitment Center in South Africa across three academic years. This training will unlock career opportunities for the young adults, not only at Porsche itself, but also with other brands in the VW Group. The programme is specifically designed to cover a wide range of topics, in order to provide trainees with a broad spectrum of opportunities. This project is being organised in association with Don Bosco Mondo e.V. together with its Don Bosco Salesian Institute Youth Projects (SIYP) in Cape Town and the Porsche importer in South Africa, LSM Distributors (Pty.) Ltd.. The three parties have signed an official memorandum of understanding today at the Porsche Centre in Johannesburg. [Read more]

Economic Partnership Agreement (EPA) between the European Union and the Southern African Development Community (SADC) EPA Group

Brussels, 10 October 2016
Today the SADC EPA enters into provisional application between the EU and Botswana, Lesotho, Namibia, South Africa and Swaziland. Mozambique is in the process of ratifying the EPA and will start applying the EPA once procedures are completed. Angola is an observer.

Under the SADC EPA, the EU will grant Botswana, Lesotho, Mozambique, Namibia, and Swaziland 100% free access to its market. The EU has also fully or partially removed customs duties on 98.7% of imports coming from South Africa. The SADC EPA states do not have to respond with the same level of market opening. Instead, they can keep tariffs on products sensitive to international competition. This is sometimes called asymmetric liberalisation. The Southern African Customs Union (SACU) removes customs duties on only around 86% of imports from the EU. Outside EPAs, the EU has never agreed before to such a degree of asymmetry in any free trade agreement. [Read more]

In the past, I, along with a partner, founded a company called Zwischenmass, which produced patterns for seamstresses. These we sold through fabric stores and via an online shop. I was responsible for the marketing of the company. To fit as many requirements as possible, I am willing to accept an occupation below my qualification.

Goethe-Institut now offers language courses for kids aged 10 to 16

Kids from the age of 10 to 16 can now learn German at the Goethe-Institut Johannesburg. Our special youth courses are particularly designed for young learners and lead up to our official FIT certification. The next course starts on 15 July. We also offer an end of the year course running from 1 October to 8 December. This course can be booked with a 10% early bird discount for everyone signing up by  September.
